Buyback allows purchasing T3 skills without 250cp at T2

After buyback of Mystic Vigor and levelling up, it allowed me to purchase Summon Phoenix.
Current T1+T2 CP spent = 140 (T1) + 20 (T2) + 50 (T2 spells) = 210 CP
idk what is counting but even if it was counting T3 spells I'd still be at 245 CP spent before T3 skills.

I was just able to do the same thing by refunding a T1 skill to get below the 70 CP spend requirement and was allowed to purchase Cosmic Affinity at T3.

I believe T3-restricted elemental spells are counted as T2 CP spent
Current CP spent for my Ele: 565 (140/155/270)
My math says I've spent 120 on T2, the remaining 35 would be attributed to a T3 bolt + aura
